Premises Liability

Premises liability is often only thought of in the context of litigation after someone becomes injured, or worse, on a property. There are three general phases of every property including design, construction, and occupancy. The occupancy phase includes that time from when the property receives a Certificate of Occupancy then throughout the property’s useful life. Although architects, engineers, and contractors are responsible to ensure a property is designed and constructed to comply with certain life-safety requirements established by applicable building codes, the building codes make it incumbent upon building owners and their agents to be responsible for properly maintaining their properties throughout the occupancy phase. Such maintenance necessitates that building owners, owner agents, and or their maintenance teams become knowledgeable of what is required to ensure the minimum requirements for health, safety, and welfare of the general public.
